The Petitioner, a life convict in case FIR No. 81/2010, registered under Sections 302/34 of the Indian Penal Code, 1860 at P.S. Sadar Bazar, assails (i) the punishment ticket dated 11^th July, 2025 issued to him, and (ii) the judicial appraisal order dated 06^th August, 2025, upholding the said punishment.

The punishment was issued on the allegation that the Petitioner selfinflicted injuries and attempted to falsely implicate a jail official. The incident was reported by Warden Praveen Kumar, whose statement is also corroborated by an independent witness, convict Jayant. Before issuance of the punishment ticket, the Petitioner was afforded an opportunity of hearing, during which he claimed that Praveen Kumar had beaten him earlier that

day, causing him distress. The punishment was thereafter judicially appraised. The record includes CCTV footage showing the Petitioner hitting his head against the wall of the administrative block and attempting to cause injuries to himself in the toilet. On the basis of this footage, it was concluded that he had deliberately caused the injuries with a mala fide intent to implicate the jail official. During the judicial appraisal, the Petitioner expressed regret, acknowledged that he had indulged in self-infliction, and stated that he was upset and distressed due to his long period of incarceration.

The judicial appraisal order dated 06^th August, 2025 reads as follows:

The allegations against the prisoner Rahul are that on 11.07.2025 Sh. Praveen Kumar, Warden called prisoner Rahul to reach Deodhy as guards with vehicle were waiting for him to produce him physically before the Court and in response prisoner Rahul threatened the duty staff by saying 'mei court date mei sar fod kar jaunga and crossing kar jaunga aur tera naam ki court mei complaint lagaunga ’ Thereafter, he attacked his own head towards wall and bleeding started from his head. After the said incident he was taken to deodhy, and reported to senior where he again threatened ‘Court date se akar mei Iasi lagaunga aur tera naamparchi par likh kar marunga. Tujhey sikha dunga duty kaise ki jati hai.’

Notice was issued to the concerned Jail Superintendent for production of the prisoner through Video Conferencing.

Accordingly, today prisoner Rahul has been produced through VC and he submits that he was upset and depressed due to his long period of stay in the jail and had no intention to break the jail mles and further prays that the punishment awarded to him may be modified on compassionate grounds.

After perusal of the entire record and the submissions of the Inmate, the punishment awarded by jail authorities to Rahul S/o Subhash for a period of one month may be modified and reduced to a period of 15 days stopping of mulakat and PICS facility.

In these circumstances, the Court finds no ground to interfere. The CCTV footage clearly records the Petitioner deliberately hitting his head against the wall and attempting self-infliction in the toilet area. The disciplinary proceedings were conducted after granting him an opportunity

of hearing, and the punishment has thereafter been judicially appraised and even modified. Moreover, the Petitioner has himself admitted to selfinfliction before the appraising judge. No perversity, procedural irregularity, or violation of statutory mandate is demonstrated so as to warrant exercise of jurisdiction.

Accordingly, the present petition is dismissed along with pending application.
