The present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarika Suraksha Sanhita, 2023 has been filed by the Petitioner seeking issuance of a writ of habeas corpus for the production of her granddaughter, Ms. 'J', who is about 15 years of age and stated to be missing since 26.03.2024.

Notice in the present Petition was issued on 29.10.2024. By the said Order the case was transferred to the Anti-Human Trafficking Unit, Crime.

Status Reports have been filed periodically. The Status Reports reveal that the Police have examined the son and daughter-in-law of the Petitioner herein and the CDRs of the Petitioner and her family members have been analyzed but no clue has been found. It is further stated in the Status Report that one person, namely, Golu@Mohit S/o Hardayal R/o House No.182, Om Nagar, Dhobi Ghat, Rana Pratap Nagar, Delhi, was interrogated by the investigating authorities at length. However, no clue of the missing child could be found. The Status Report further reveals that on the basis of the information received, the minor girl was searched in the area of Khajuri and Bhajanpura but the missing girl could not be traced. It is stated that standard operating procedure has meticulously been followed and Hue and Cry Notices containing the details of the missing girl were sent to all the concerned agencies, i.e. Missing Person Squad, CIC/CBI, etc. for broadcasting the same on local TV channels and leading newspapers. It is further stated in the Status Report that Hue and Cry Notices were pasted at Maharana Pratap Kashmiri Gate ISBT, New Delhi Railway Station and Old Delhi Railway Station. It is further stated in the Status Report that the missing girl was searched in Civil Lines, Mukherjee Nagar, Maurice Nagar and Hue and Cry Notices have been pasted in the prominent areas of Delhi and enquiries have been made at various levels and Asha Kiran Home, Rohini was also searched. It is stated that despite best efforts, no clue regarding the missing girl has been found so far.

In view of the fact that the case has already been transferred to AntiHuman Trafficking Unit, Crime and all possible steps have been taken by the Investigating Authorities to trace the missing girl but the girl could not be found, this Court is inclined to dispose of the present Writ Petition with a

direction to the Anti-Human Trafficking Unit, Crime to file monthly Status Reports before the concerned Metropolitan Magistrate with an advance copy to the Petitioner and if any clue is found about the minor girl of the Petitioner, the same be communicated to the Petitioner.
