It is submitted that on an earlier occasion, in W.P.(Crl.) 1759/2015, this Court had entertained a similar request and, by order dated 06^th November, 2015, diluted the conditions and permitted the Petitioner to travel to Punjab. The said order reads as follows:

The petitioner seeks modification of the order dated 18.09.2015 passed by this Court in W.P.(Crl.)1759/2015 to the extent that the condition imposed upon the petitioner for not leaving the territorial bounds of the National Capital Territory of Delhi be waived.

By the aforesaid order dated 18.09.2015, the petitioner was released on parole for a period of 30 days on his furnishing a personal bond in the sum of Rs.5,000/- with one surety of the like amount to the satisfaction of the Trial Court. One of the terms and conditions of the parole was that the petitioner would not leave, under any circumstance, the National Capital Territory of Delhi.

It is submitted on behalf of the petitioner that he has remained in jail for about 11 years and that parole was granted for reconnecting social ties.

The son of the petitioner, who is a resident of Punjab, has offered himself as surety to the petitioner. The petitioner has no connection whatsoever in Delhi and for reconnecting social ties, he is required to go to Punjab.

Considering that aspect of the matter, the order dated 18.09.2015 is modified to the extent that in case the petitioner desires to leave the territorial bounds of NCT of Delhi, he shall intimate about his programme to the SHO of the Kalkaji police station and would give his and his surety’s contact number.

If the petitioner goes to the Punjab, he shall communicate about his arrival to the SHO of the concerned police station, under which territorial jurisdiction, the petitioner would be residing.

Mr. Raghuvinder Varma, APP, submits that the Punjab address of the petitioner has been verified and affirmed.

Thus, the order dated 18.09.2015 stands modified to the extent indicated above.

The other conditions which were imposed on the petitioner shall subsist during the period of parole.

The application is allowed and disposed of accordingly.

The residential address of the Petitioner as noted in the order dated 06^th November, 2015, stands verified.

Accordingly, the request is allowed and the order dated 16^th October, 2025, is modified. It is directed that if the Petitioner intends to leave the NCT of Delhi, he shall intimate his travel programme to the SHO of P.S.

Kalkaji along with his contact details. Upon travelling to Punjab, he shall inform his arrival to the SHO of the police station under whose jurisdiction he will be residing.

Consequently, condition Nos. (i) and (iii) of the order dated 16^th October, 2025, stand modified to the extent indicated above. All other conditions imposed on the Petitioner shall remain in force during the period of parole.

Further, the request for reduction of the bail bond amount is also allowed. The Petitioner shall furnish a personal bond in the sum of ₹10,000/with one surety of the like amount, instead of ₹15,000/- as earlier directed. 10. The application is allowed and disposed of.
