Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( hereinafter referred to as ‘B.N.S.S. ’)/under Section 482 of the Code of Criminal Procedure, 1973 ( hereinafter referred to as ‘Cr.PC’ ), has been filed on behalf of the Petitioners, for quashing of FIR No. 208/2016 under Section 328/366/506/34 of the Indian Penal Code, 1860 ( hereinafter referred to as ‘IPC ’) registered at Police Station New Ashok Nagar, Delhi and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 28.09.2024.

As per the FIR, the Prosecutrix was administered some intoxicating substance by the Petitioners and while she was unconscious, she was made to sign some papers, which ultimately turned out to be some marriage documents. After gaining consciousness, she felt severe pain and made the present Complaint. Pertinently, she has also taken ex-parte divorce under Section 12(1)(c) of the Hindu Marriage Act, on the deposition that her consent was not free but was under the influence of intoxication. These submissions of the Respondent No. 2, have been accepted in the ex-parte divorce decree dated 15.01.2019.

It is pertinent to note that while on one hand, she is claiming that she became unconscious but on the other hand, by some providence that she was able to sign the document under the state of unconsciousness. Not only this, the alleged documents are informed to be registered documents. It is quite evident that the mala fide in getting the FIR registered, is writ large on its face. However, the parties have now entered into a Compromise dated 28.09.2024 wherein they have sought the quashing of the FIR. It is submitted on behalf of the Respondent No. 2 that she soon to get re-marry and for this reason, she wants to FIR to be quashed.

On the Complaint of the Respondent No.2/Complainant, FIR No.208/2016 under Section 328/366/506/34 of IPC, got registered at Police Station New Ashok Nagar, Delhi.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 28.09.2024. It is also settled between the parties that they will not create any further hindrance in respect of their past or any grievance incurred in their past life.

Today, the Respondent No. 2, who is present in the Court, states that she has no objection if the FIR is quashed.

The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 10. Considering the totality of circumstances, the FIR No. 208/2016 under Section 328/366/506/34 of IPC, registered at Police Station New Ashok Nagar, Delhi and all the consequential proceedings emanating therefrom are quashed. However, considering the entire conduct of the Complainant, cost of Rs.10,000/- be imposed upon the Respondent No. 2, to be deposited within seven days, to the Registrar General of this Court. In case, she fails, the same may be realised as the land revenue.

The Petition is disposed of accordingly.
