.1. Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( hereinafter referred to as ‘B.N.S.S. ’)/under Section 482 of the Code of Criminal Procedure, 1973 ( hereinafter referred to as ‘Cr.PC’ ), has been filed on behalf of the Petitioner, for quashing of FIR No.22/2021 under Section 279/304A of the Indian Penal Code, 1860 ( hereinafter referred to as ‘IPC ’) registered at Police Station North Avenue, New Delhi and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 16.12.2024.

On advance Notice, learned APP for the State has appeared and accepted the Notice on behalf of the State.

As per the FIR, Smt. Nimiya Devi, wife of the Respondent No. 2, namely, Bita Ram, suffered grievous injuries, which proved to be fatal. The

deceased was survived by her husband and five adult and minor children, who all have given no objection stating that the compensation amount has been given to the father, as per the terms of the Settlement.

On the Complaint of the Respondent No.2/Complainant, FIR No.22/2021 under Section 279/304A of IPC, got registered at Police Station North Avenue, New Delhi. 6. It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them vide Settlement dated 16.12.2024. The Petitioner has paid Rs.2,00,000/- as the compensation amount to the Respondent No. 2. In addition, the Respondent No. 2 has received Rs.9,40,000/- through MACT Court.

Today, the Respondent No. 2/Complainant, who is present in the Court, states that he has received all amounts due to him and has no objection if the FIR is quashed. 8. The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 9. Considering the nature of the allegations and that they have settled the matter, the FIR No. No.22/2021 under Section 279/304A of IPC, registered at Police Station North Avenue, New Delhi and all the consequential proceedings emanating therefrom are quashed 10. The Petition is disposed of accordingly.
