The instant petition under Article 226 of the Constitution of India has been filed on behalf of the petitioner seeking the following reliefs:

“a) Issue a Writ of Certiorari or any other Writ, Order and/or Directions thereby directing the Respondents to investigate the

alligations of insider trading against Anil Hiralal Shah @ Raju Barter @ Raju Shah and Atul Hiralal Shah together known as Barter Brothers and various firms/companies under their direct/indirect control.

b) Such further directions/orders and other reliefs as the nature and circumstances of the case may require be also passed in the interest of justice.”

Learned counsel for the petitioner submitted that the petitioner represented its case to the concerned authority (s) vide representation dated 1^st August, 2022. It is further submitted that in the said representation it was prayed that the investigation may be done by the investigating agency taking into consideration the Parliamentary Committee Report. Therefore, she seeks an innocuous prayer that instant petition may be treated as representation before the concerned authority(s) and this Court may direct the concerned authority (s) to decide the said representation expeditiously.

Learned counsel appearing on behalf of the respondent-CBI vehemently opposed the instant petition, however, has no objection to the innocuous prayer made by the learned counsel for the petitioner. 4. Heard learned counsel for the parties and perused the record. 5. After perusal of the record, contentions made in the petition as well as the innocuous prayer made on behalf of the petitioner and no objection on behalf of the respondents, this Court is inclined to allow the innocuous prayer made by learned counsel for the petitioner.

Accordingly, the petitioner is directed to move appropriate application along with the copy of the instant petition with the representation, which is annexed as Annexure P-4 to the instant petition, as well as the copy of the instant petition and the certified copy of this order

before the concerned authority(s) within one week. After receiving the said application, the concerned authority(s) is directed to treat the said application as detailed representation and to dispose of the same after hearing the petitioner and pass a detailed and reasoned order in accordance with law expeditiously, preferably within eight weeks.

With the aforesaid directions, the instant petition is disposed of along with pending applications, if any.
