This hearing has been done through hybrid mode.

The present petition under Sections 11 and 12 of the Contempt of Courts Act, 1971 seeks the following prayers: -

¶12

“a) Initiate contempt proceedings against the Respondents/ Contemnors for willful disobedience of the judgment dated 03.02.2025 passed in W.P.(C) 988/2019;

¶13

b) Direct the Respondents to forthwith comply with the said judgment and release all retiral and pensionary benefits to the Petitioner without further delay;

¶14

c) Pass any other or further order(s) as this Hon'ble Court may deem fit and proper in the interest of justice.”

In pursuance of the order dated 06.10.2025, a compliance affidavit dated 11.11.2025 has been filed by Dr. Vimal Kumari Arya, Medical Superintendent, Kalawati Saran Children’s Hospital, New Delhi. A copy of the same has been handed up in the Court today and the same has been taken

on record. In the said affidavit, it has been recorded as under: -

“4. That the Respondents vide their Office Order, dated 08.11.2025, in compliance with the directions of this Hon'ble Court have posthumously regularized the services of Late Shri Sanjeev Kumar (Petitioner's husband) w.e.f. 15.03.2011 till the date of his death, i.e. 27.03.2016. Further, the Respondents have also approved the release of all the retiral benefits admissible to his dependent family members as per rules and requested the Petitioner, vide office order dated 08.11.2025, to fill up the pension papers and complete the documentary formalities to facilitate the release of the said amount. Copy of the Office Order dated 08.11.2025 is annexed herewith as Annexure-C-1.

That it is respectfully submitted that all the admissible retiral benefits of Late Shri Sanjeev Kumar (Petitioner’s husband) shall be released to the Petitioner by the Respondents as expeditiously as possible after verifying the necessary documents from the Petitioner.

That the present affidavit may be treated as compliance of order dated 03.02.2025 of this Hon'ble Court in WPC No. 988/2019 by the Respondents.”

Petitioner, who appears in-person, submits that he has sought time from the respondent to submit the necessary documents to complete the formalities to facilitate the release of all the retiral benefits.

Learned counsel appearing on behalf of the respondent, on instructions, submits that the petitioner may appear before the concerned authority, i.e., Medical Superintendent, Kalawati Saran Children’s Hospital, New Delhi, on 14.11.2025 at 04:00 P.M.

In these circumstances, the petition is disposed of with the directions that the retiral benefits would be released to the petitioner as expeditiously as possible after verifying the necessary documents, preferably within a period
