Learned counsel appearing on behalf of the respondent no. 1 has handed up in Court today a copy of the compliance affidavit dated 11.08.2025, authored by Arvind Kumar, Project Director, PIU Ghaziabad, and the same has been taken on record. In the said compliance affidavit it has been stated as under: -

<5. An encroachment removal drive was conducted on 04.08.2025, during which, with the assistance of the District Administration, NHAI'S Concessionaire successfully removed all encroachments. Photographs evidencing the same are annexed hereto and marked as Annexure R- 2/2 . Letter dated 11.08.2025 of the Concessionaire, evidencing that the encroachments has been removed is also annexed and marked as Annexure R-2/3.”

Respondent no. 2 has also handed up in Court today a communication dated 11.08.2025, authored by Prashant Kumar Singh, Project Head, and the same has been taken on record. The said communication also confirms that encroachment removal had been done on 04.08.2025.

In these circumstances, no further directions are called for.

Needless to state that respondents shall ensure that no further encroachment be made at the subject property.

Learned counsel appearing on behalf of the petitioner submits that the construction is still on-going, however, nothing has been placed on record to show the same.

In case of any future encroachment, the petitioner shall be at liberty to revive the present petition.

¶25

The present petition is disposed of in the aforesaid terms.
