The petitioner is seeking initiation of contempt proceedings against the respondents for the willful disobedience and noncompliance of the directions of this Court contained in the orders dated 30.05.2022 and 01.11.2022 in W.P.(C) No. 4296/2018 followed by the final orders which have been passed by the Supreme Court vide order dated 08.02.2024 and 05.11.2024.

Learned counsel for the respondent is present on advance notice with the concerned officials.

Learned counsel for the petitioner appearing through VC, has urged that the entire reimbursement has not been done towards House Rent Allowance [hereinafter referred as “ HRA ”] as well as the transport allowance and he has also pointed out that in terms of the order dated 01.11.2022 passed by the Division Bench of this Court, the respondents had also been burdened with a cost of Rs.50,000/-.

Learned counsel for the respondents has urged that the impugned orders dated 30.05.2022 and 01.11.2022 were challenged before the Supreme Court in Civil Appeal No. 4967/2023 and the Supreme Court vide order dated 08.02.2024 directed that the HRA be disbursed within three months of the passing of the order, failing which it was directed that the amount payable will carry interest @ 8% p.a., as was ordered by the High Court, from the date of judgment in favour of the petitioner till realization.

During the course of arguments, it is acknowledged by learned counsel for the petitioner appearing through VC, that the amount of Rs.27,000/- has been paid towards the HRA. It is also acknowledged that a sum of Rs.5439/- has since been paid towards the interest amount as well.

However, learned counsel for the petitioner submits that the transport allowance has not yet been paid. 7. Learned counsel for the respondents submits and places on record a letter dated 26.02.2025, whereby the petitioner has been called upon to submit his claim with regard to all transportation charges and travelling allowances payable to him and his family members from CISF Unit, IGI Airport, New Delhi to CISF Unit, CGPL Mundra.

Let the said letter be digitized and placed on the record.

Let the relevant information as per the Letter dated 26.02.2025, be supplied by the petitioner to the respondents within two weeks from today and the said allowances be paid to the petitioner within four weeks thereafter, failing which the respondents shall be liable to pay interest @ 8% p.a. from the date of the filing of the application/details by the petitioner till realization.

Insofar as the payment of Rs.50,000/- and cost are concerned, in view of the directions of the Supreme Court dated 08.02.2024, the said amount cannot be said to be payable by the petitioner.

The present contempt petition is disposed of accordingly. Pending applications, if any, are also disposed of.
