The present petition under Section 10 read with Section 12 of the Contempt of Courts Act, 1971 seeks the following prayers:-

“a. Initiate contempt proceedings against the Respondent/Contemnor and punish them in accordance with the law;

b. Direct the Respondent /Contemnor to comply with the directions contained in final order dated 09.12.2024 passed by this Hon’ble Court in W.P. (C) No. 16975 of 2024;

The present petition has been filed alleging non-compliance of order dated 09.12.2024 in W.P.(C) 16975/2024 in particular the following directions:-

“7. In light of the above, the instant writ petition is disposed of with a direction to L&DO to examine the issue highlighted above and in case there is a violation of clause VIIA of the lease agreement dated14th May,1976, take appropriate action, if any, in accordance with law.”

Learned counsel for the respondent, handed up in Court today an communication dated 31.07.2025 to legal notice dated 27.05.2025 issued on behalf of the petitioner alleging non-compliance of the aforesaid order. The aforesaid communication records as under:

“3. It is submitted that in response to your notice alleging noncompliance with Clause VII-A of the Agreement of Lease, which mandates the inclusion of two nominees of the President on the Managing Committee of the club with full voting rights, we submit that this office has, in the past, appointed nominees to the Managing Committee of the club on a regular basis, as required under the lease agreement. The appointment of such nominees is a procedural matter internal to this office and is carried out in a routine manner in accordance with established protocols.

At present, this office is in the process of ensuring that the requisite nominees are duly appointed and integrated into the Managing Committee of the club, as per Clause VII-A. Any delay in the formal appointment of nominees does not constitute willful disobedience of the court’s order, as the process is administrative in nature and is being actively addressed. This office remains committed to ensuring compliance with the lease agreement in this regard.

Thus in the light of the above, it reiterated that this office is in full compliance with the Hon’ble High Court’s order dated 09.12.2024. The allegations of willful disobedience or contempt

are baseless, as this office has consistently acted in accordance with the law and the terms of the Agreement to Lease.”
