The present petition under Section 12 of the Contempt of Courts Act seeks following prayers:-

“i. Pass an order thereby initiating contempt proceedings against the respondent no.1 for willfully and deliberately disobeying / violating the order dt.16.09.2025 passed by Hon'ble High Court of Delhi in W.P. (C) No.14307 /2025 titled as "Sarvan Kumar Sharma & Ors. Vs. MCD & Anr." and also punish the respondent no. 1 according to law; ii. Pass any other order/ relief which this Hon 'ble Court may deem fit and proper under the facts and circumstances of the case in favour of the petitioners and against the respondents”

Vide order dated 16.09.2025 in W.P.(C) 14307/2025, the learned Single Judge had passed the following order: -

“2. Responding to the present writ petition, learned counsel appearing for the respondent-Municipal Corporation of Delhi ("MCD"), submits that the property was booked on 251h April, 2025, and after following the due procedure, a Demolition Order has also been passed.

She further submits that the MCD has already fixed action for demolition on 17th September, 2025.

In view of the aforesaid submission made by learned counsel appearing for the respondent-MCD, no orders are required to be passed by this Court.

However, it is clarified that this Court has not expressed any opinion on the merits of the action, being undertaken by the MCD. 6. In case, the petitioners are aggrieved by any non-action on the part of the MCD, they shall have liberty to approach the Special Task Force ("STF"), as constituted by the Supreme Court, in terms of the orders passed by the Division Bench of this Court in the case of Devender Versus Govt. of NCT of Delhi and Ors., in W.P. (C) 180712018 and Fazruddin Versus DDA and Ors. in W.P.(C) 464912017.”

Learned counsel appearing on behalf of the petitioner seeks leave of this Court to withdraw the present petition, with liberty to approach the Special Task Force (STF) as observed by the learned Single judge in the aforesaid order.

Leave and liberty granted.

The present petition is dismissed as withdrawn and disposed of.
