This is an application under Section 9 of the Arbitration and Conciliation Act, 1996 which was filed pre-award.

During the pendency of this application, an award has been passed and the same is the subject matter of challenge in OMP(COMM) 208/2024. The award is also sought to be enforced in OMP (ENF.) (COMM.) 23/2024. 3. Since the award has already been pronounced and the mandate of the arbitrator stood expired, under these circumstances, the application filed under Section 9 of the Arbitration and Conciliation Act, 1996 has been

rendered infructuous. However, it is submitted by Mr. Uttam Datt, learned senior counsel appearing for the applicant that there were certain interim arrangements which the Court had made in O.M.P.(I) (COMM.) 424/2023 vide order dated 03.01.2024.

Since the enforcement petition is pending and Section 34 application is also sub judice, under these circumstances the interim order passed in this petition shall be read to have been passed in OMP (ENF.) (COMM.) 23/2024. The interim order, therefore, will remain in operation in that case. 5. The O.M.P.(I) (COMM.) 424/2023, however, is disposed of.
