Guardianship / child welfare — CM(M) 2186/2025 (Delhi HC, Saurabh Banerjee, J., 14.11.2025): Petitioner-mother sought to challenge three collective orders dated 23.10.2024, 17.10.2025 and 18.10.2025 arising out of a guardianship petition pending before the Family Court concerning the couple's six years old son. To secure maintainability, she gave up the reliefs qua the orders dated 23.10.2024 and 17.10.2025, reserving liberty to pursue remedies thereon, and confined the petition to the order dated 18.10.2025. The Court found prima facie no reason to interfere with that order; however, having regard to the betterment of the child and the fact that the child has resided with the mother for the last one and a half years, it directed that the mother may be present during the visit of the father before the Child Counsellor, if the Counsellor deems it fit, proper and appropriate. Although, the petitioner seeks to challenge three collective orders being 23.10.2024, 17.10.2025 and 18.10.2025, however, without adverting to the merits involved, and so as to clear the way for maintainability of the present petition, learned counsel for the petitioner submits that she is willing to give up the reliefs qua the orders dated 23.10.2024 and 17.10.2025 with liberty to seek appropriate remedies in accordance with law and restrain her submissions in the present petition to the order dated 18.10.2025.

This Court has heard the learned counsel for the parties.

Prima facie , this Court finds no reasons for interfering with the order dated 18.10.2025, however, considering that the present petition is arising out of a guardianship petition pending before the learned Family Court and is involving a six years old son, for the betterment of the child as also in the interest of justice, it is felt appropriate to allow the presence of the mother during the visit of the father before the Child Counsellor, if it is so deemed fit, proper and appropriate by the Child Counsellor.
