The is the second anticipatory bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023¹ (formerly Section 438 of the Code of Criminal Procedure, 1973² ) seeking pre-arrest bail in proceedings emanating out of FIR No. 20/2025, dated 10^th January, 2025 registered under Sections 118(1)/126(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023³ at P.S. Prashant Vihar. The Applicant’s previous anticipatory bail application had been dismissed by the Sessions Court by order dated 1^st February, 2025.

Briefly stated, the case of the Prosecution is that, on 10^th January, 2025, a PCR call was received at P.S. Prashant Vihar regarding an incident of assault, which was taken up for investigation. Upon reaching the spot, the

Investigating Officer⁴ found that the injured persons had already been taken to an unknown hospital. Later, an MLC was received from Ishan Hospital, and the statement of one Govind Sisodia, the Complainant, was recorded. He stated that on 9^th January, 2025 at around 11:30 PM, while he was seated in a Baleno car with his uncle Premraj and two of his uncle’s friends, Dinesh and Arjun, another car stopped in front of them. Two individuals exited the vehicle, including the present Applicant, one wielding a knife and the other a wooden stick (“danda”), and began assaulting them. He further stated that the assailant with the knife attacked him, causing injuries to his forehead, and also assaulted his uncle, Premraj, inflicting injuries on his face while the other assailant used the wooden stick to break the windshield of the Baleno car. Thereafter, both assailants fled the scene. On investigation, a knife and the damaged Baleno car were recovered from the place of incident. On the basis of Govind’s statement, FIR No. 20/2025 was registered and investigation commenced.

The Applicant has thereafter filed the present application seeking prearrest bail. During the course of the proceedings, interim protection was granted to the Applicant by an order of this Court dated 6^th March, 2025, with a direction to join the investigation. Since then, the Applicant has appeared before the IO on several occasions and the investigation is now nearing completion.

Further, the court is apprised that there is a settlement between the Applicant and the Complainant and they have jointly applied for quashing of the abovementioned FIR by way of a separate petition [Crl.M.C. 1265/2025] before this Court. Moreover, the other co-accused has already been

granted anticipatory bail by the Sessions Court by order dated 6^th June, 2025.

Having regard to the aforenoted circumstances and the fact that the Applicant has been cooperating in the investigation, the application is allowed and in the event of arrest, the Applicant shall be released on anticipatory bail on furnishing personal bond of INR 20,000/- with one surety of the like amount subject to the following conditions:

(i) The Applicant person is directed not to threaten prosecution witnesses in any manner or tamper with evidence or indulge in any other criminal activity in future;

(ii) The Applicant shall join investigation as and when called by the Investigating Officer and he shall also appear before the Court on each and every date of hearing;

With the above directions, the present petition stands disposed of along with pending applications.

It is clarified that the observations, if any, made in this order are strictly confined to the disposal of the bail application and must not be construed to have any reflection on the ultimate merits of the case.
