This is an application filed on behalf of the applicant/accused for the grant of interim bail on medical grounds for a period of 2 months in case FIR no. 121/2025 under Sections 18/29 NDPS Act, registered at PS Crime Branch.

Learned counsel for the petitioner submits that petitioner is suffering from tuberculosis and is not receiving adequate treatment at jail. He is having breathlessness, dizziness, losing weight and is having high blood pressure. Request has been made for grant of interim bail for a period of 02 months.

The bail application has been opposed by learned APP stating that the allegations against the applicant are serious in nature. He further states that petitioner is receiving adequate treatment at the jail hospital and thus, petitioner is not liable for grant of interim bail.

Mandoli Jail reveals that the applicant is suffering from pulmonary tuberculosis, for which he took treatment for 06 months about 2 years ago. As per the report, the applicant approached the jail OPD on 25.08.2025 with complaint of cough with sputum, on and off fever since last 07 days. The applicant was immediately referred to GTB Hospital for evaluation and management and upon receipt of sputum report, it was confirmed that he was suffering from tuberculosis and he has been put on anti-tuberculosis treatment.

The report further reveals that applicant is on medications from the jail dispensary along with anti-tuberculosis treatment medicines from DOT centre/GTB Hospital and is being provided the prescribed medical diet as per the jail rules.

The report does not indicate the applicant is suffering from any illness which cannot be managed or treated from the jail hospitals/referral hospitals. Rather, the report indicates that the applicant is receiving satisfactory treatment both from the jail dispensary as also from the GTB Hospital. I, therefore, find no justification for the grant of interim bail to the applicant.

The application is, therefore, dismissed.

However, the jail superintendent is directed to ensure that the best possible treatment is provided to the applicant as per the advice of the doctor.
