M/S M.S. Contractor Thr. Proprietor Mr. Manmeet Singh Vs Union of India & Anr.

The Petitioner has approached this Court under Section 11 of the Arbitration & Conciliation Act seeking appointment of an Arbitrator to adjudicate upon the disputes between the parties.

It is stated that the Petitioner was awarded the contract for parking of cycles, scooters, car, bus, truck and tempo at Delhi first entry Railway Station. It is stated that because of the onset of COVID-19 pandemic in March, 2020 disputes arose between the parties regarding payments to be made under the contract.

It is stated that the Petitioner issued a legal notice dated 27.05.2024 to the Respondent invoking arbitration under Section 21 of the Arbitration & Conciliation Act. It is stated that the Clause 27 of the agreement contains an arbitration clause. Since the parking site was at Delhi, cause of action arises in Delhi, and the seat of arbitration is therefore at Delhi.

Learned Counsel for the Respondent/Union of India states that he does not dispute the existence of arbitration clause.

Accordingly, Ms. Arundhati Katju, Senior Advocate (Mob: 9910049248) is appointed as a Sole Arbitrator to adjudicate upon the disputes between the parties.

The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration & Conciliation Act within a week of entering on reference.

All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.

Needless to say, nothing in this order shall be construed as an expression of this Court on the merits of the contentions of the parties.

The present petition stands disposed of in the above terms along with pending application(s), if any.
