The facts of the case would indicate that with respect to the same controversy, earlier an Arbitrator was appointed vide order dated 01.05.2024 in ARB. P. 210/2024. The concerned arbitrator had expressed his inability to conduct the arbitration and accordingly, the instant petition has been filed.

In view of the aforesaid, the Court finds that as per Clause 15 of the Vendor Agreement for Services/ Material Supply/Works dated 23.12.2021,
