The present petition has been filed by the petitioner assailing an order vide file no. VII/402/App-57/2024 dated 21.10.2024 issued under Sections 10(3)(b ), 10(3)(e), and 10(3)(h), of the Passport Act, 1967, passed by the respondent no.1.By way of the said order, the respondent no.1 upheld the impugned direction of the respondent no.2/Consulate General of India, Dubai, for impounding of the petitioner’s passport as per the order dated 06.05.2024.

Learned counsel for the petitioner submits that the impounding of the petitioner’s passport was completely misconceived inasmuch as it is predicated on the show cause notice dated 17.11.2023 which was never served on the petitioner. The same is, however, disputed by the learned counsel for the respondent no.1.

Learned counsel for the petitioner also emphasises that various orders have been passed by the concerned Trial Court/s which are seized of the criminal cases, where the petitioner has been sought to be implicated,

After some hearing, it is agreed that in the event the petitioner obtains fresh orders from the concerned trial Court seeking permission to depart from India / travel abroad (after disclosing all relevant facts to the concerned trial Court, including as regards the impounding action taken by respondent no.1), the respondents shall forthwith take steps to revoke the impounding action, and comply with the directions of the trial Court. The said statement is taken on record.

As such, upon requisite order/s being passed by the trial Court, there shall be no impediment to the petitioner undertaking travel in terms thereof. 6. The present petition stands disposed of in the above terms. The pending applications also stand disposed of.
