Heard the learned counsel for the parties.

By filing this public interest litigation petition, a direction has been sought for ensuring compliance of the Circular dated 12.10.2020 which has been issued with the object of making a provision that any adult male worker is not compelled to lift more than 50 kgs of weight of bundles/sacks of agricultural produce at a time.

The submission is that despite the said Circular dated 12.10.2020, it is common knowledge that the labourers being employed by Agricultural Produce Marketing Committee are made to lift weight more than 50 kgs. Reliance has also been placed on a letter dated 28.03.2025 written by the

National Human Rights Commission drawing attention of the Secretary, Delhi Agricultural Marketing Board, as also the Commissioner of Police, Delhi that a complaint in this regard has been made on 06.01.2025 and therefore appropriate action be taken by the concerned authority. It has been stated by learned counsel for the petitioner that despite the said letter written by the National Human Rights Commission, the malpractice of requiring the labourers to lift weight of more than 50 kgs is still prevalent.

Accordingly, having regard to the overall facts and circumstances of the case, and also keeping in view the Circular dated 12.10.2020 as also the letter of the National Human Rights Commission, we permit the petitioner to take up the case with the Delhi Agricultural Marketing Board by way of making a representation within a fortnight.

Once any such representation is made, the same shall be considered and appropriate action which may be warranted under the law shall also be taken by the competent authority of the Board with expedition. The decision and the action which ensue pursuant to our direction to be taken by the Delhi Agricultural Marketing Board shall also be communicated to the petitioner. 6. With the aforesaid directions and observations, the writ petition is disposed of.
