The present petition has been filed by the petitioner seeking the following prayer:

“1. For issuance of an appropriate writ, order or direction in the nature of mandamus or any other appropriate writ thereby directing the respondent no.1 to dispose off the representation dated 8/9/2025 of the petitioner expeditiously and direct the R2 to R4 to vacate the premises of petitioner i.e. house no.19, village Jaitpur south east Delhi

2. Any other further order which this court thinks fit and proper.”

The petitioner, a senior citizen, has alleged harassment at the hands of her daughter-in-law/ respondent no.2 and grand children i.e. respondent no. 3 and 4 in the present petition.

Learned counsel for the petitioner submits that an application for eviction has been submitted by the petitioner before the District Magistrate, South-East seeking redressal of her grievance. The same reads as under:

It is to submit that I Jeet Kaur wife of Late Bachan Singh r/o House no. 109, village Jaitpur South East Delhi is much suffering at hands of Asha Kaur daughter in law of mine and her sons Luvdeep and Jasdeep. Daily

these people are torturing me by abusing and sometimes beat me up. Complaints to Police attached and local police officials are in connivance of Asha Kaur, hence no action taken.

Asha Kaur is also forcefully making up extra floors via which cracks in house occurring and also many goons comes to her, who wants to purchase my property from her in cheap rate. In the facts please give me protection and evict my house from above-mentioned.

Learned counsel for the GNCTD/respondent no.1 submits that it is incumbent upon the petitioner to file an appropriate complaint as contemplated under the Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2009, whereupon the concerned District Magistrate would necessarily consider the same and pass appropriate order therein, in accordance with law.

Given the sketchy and inchoate nature of the application (as reproduced hereinabove), it is not possible for the District Magistrate to act on the basis thereof.

In the circumstances, the present petition is disposed of by granting liberty to the petitioner to file appropriate application under the Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2009, before the concerned District Magistrate. The same shall be duly considered in accordance with law. The District Magistrate is requested to bestow its urgent consideration to the complaint that may be filed by the petitioner.

The present petition stands disposed of in the above terms. Pending application also stands disposed of.
