The University Grants Commission (High Court of Delhi, W.P.(C) 13848/2025 & CM APPL. 56793/2025, Vikas Mahajan, J., 09.09.2025): Petitioner sought (a) mandamus directing UGC to act against Diana College of Nursing for illegal retention of his original certificates, (b) steps to enforce UGC Notification D.O.No-13/2007(CCP-II) dated 06.12.2016 and the December 2016 notification on "Remittance and Refund and Other StudentCentric Issues", or alternatively (c) directions to consider his representation dated 22.11.2024. Learned counsel for the petitioner confined the prayer to clause (c). None appeared for the respondents despite advance service. The Court disposed of the petition directing respondent no.1/UGC to dispose of the representation dated 22.11.2024 (Annexure P-5) within four weeks by passing a speaking order, and to communicate a copy thereof to the petitioner and his counsel within two weeks thereafter. The present petition has been filed by the petitioner seeking following relief:

“(a) Issue a writ of mandamus directing the Respondent to take appropriate action against Diana College of Nursing for the illegal retention of the Petitioner’s original certificates.

(b) Issue a writ of mandamus directing the Respondent to take appropriate steps to ensure effective enforcement of the Notification issued by the Respondent vide D.O.No-13/2007(CCP-II) dated 06.12.2016, along with its elaborate notification on “Remittance and Refund and Other StudentCentric Issues” dated December 2016 Alternatively;

(c) Issue directions to the Respondent to consider the Representation dated 22.11.2024.”

The learned counsel appearing on behalf of the petitioner submits that

for the time being the petitioner only wishes to confine his prayer to an alternate relief in prayer clause (c) and urges the Court that necessary directions may be given to the respondent no.1/UGC to consider the representation dated 22.11.2024 made by the petitioner and dispose of the same.
