Learned Counsel for Respondent No.2 submits that the Impugned Order has been passed by the Additional Senior Civil Judge and that Appeal against such an order is maintainable only before the District Judge.

Learned Counsel for the Appellant fairly agrees that the Appeal has inadvertently been filed before this Court. He seeks permission to withdraw the present Appeal with liberty to approach the appropriate forum.

The Liberty is so granted to the Appellant.

The Appeal and all pending Applications are accordingly dismissed as withdrawn.
