The grievance of the Petitioner as articulated in his Petition is that the exit date as submitted by the Respondent No.3 (previous employer of the Petitioner) was incorrectly submitted in the EPF Account of the Petitioner. 4. Learned Counsel for the Petitioner submits that although the Petitioner has time and again requested Respondent No.3 to correct the records of the Respondent No.2 Authority to show an exit date of 04.04.2019 instead of 20.05.2019, the same has not been complied with by

the Respondent No.3. Thereafter, the Petitioner made a representation for such correction before the Respondent No.2 which has also not received any response.

Issue Notice.

5.1 Learned Counsel for Respondent No.1 and 2 accepts notice.

Given the order that this Court intends to pass, no notice is required to be issued to Respondent No.3.

The Petitioner has made a representation to the Respondent No.2 on 24.06.2024 wherein the Petitioner has requested Respondent No.2 to examine the issue and rectify the exit date as appearing in the EPF records.

With the consent of the parties, the matter is taken up for hearing and disposal today. Learned Counsel for the Respondents submit that the Petitioner can approach Respondent No.2 for a resolution of his grievance.

In the aforegoing circumstances, the following directions are passed:

9.1 The Respondent No.2 is directed to treat the Annexure F and this Petition as a Representation and decide the same by a speaking order as directed herein.

9.2 The Petitioner and/or his authorised representative will be given an opportunity to be present for a hearing before Respondent No.2 on 17.09.2024 at 3 PM.

9.3 The Petitioner is permitted to produce any additional facts or documents in support of her contentions, at the time of hearing. In the event, if it is deemed necessary, that there is a need for more than one hearing, the Petitioner and Respondent No.2 may mutually schedule such additional hearings amongst themselves as well.

9.4 The Respondent No.2 shall pass a Speaking Order as expeditiously as

possible and no later than eight weeks from today.

9.5 The Speaking Order shall be communicated to the Petitioner under acknowledged postal service and e-mail.

It is made clear that this Court has not expressed any opinion on the merits of the case. All rights and contentions of the parties are left open in this regard.

The Writ Petition and all pending Applications are disposed of with the aforesaid directions.

Needless to add, that in the event the Petitioner is aggrieved with the order passed by the Respondent No.2, he may take appropriate steps in accordance with the law.
