This Petition under Section 29A(4) and 29A(5) of the Arbitration and Conciliation Act, 1996, read with Section 7 of the Commercial Courts Act, 2015, has been filed by the Petitioner for extending the mandate of the sole arbitrator in the Arbitration proceedings which are going on between the parties.

Material on record indicates that the Arbitral Tribunal was constituted in terms of the Order dated 11.10.2021, passed by this Court in ARB.P.972/2021.

Extension of six months was sought by the Arbitral Tribunal and vide Order dated 06.09.2023, the mandate of the Arbitral Tribunal was extended

till 29.02.2024. Further extension of six months was sought and this Court vide Order dated 26.02.2024 extended the mandate of the Arbitral Tribunal till 22.09.2024.

It is stated by the learned Counsel for the Petitioner that final arguments have been heard and written submissions have been filed by the parties before the Tribunal and the Tribunal has informed the parties that it would require time till 31.01.2025 to prepare the final award.

In the facts and circumstance of this case, this Court is inclined to extend the mandate of the Arbitral Tribunal till 29.03.2025 so that the award can be pronounced and no further extension of time would be required by the Tribunal.

The Petition is disposed of, along with the pending applications, if any.
