Learned counsel for the respondent submits that since the respondent has not been able to find any other suitable alternative accommodation, she will, without prejudice to her claim, shift to a more suitable accommodation having the same rental of Rs.40,000/- per month. In fact, she will shift to the rented accommodation i.e. G-50, Upper Ground Floor, East of Kailash, New Delhi-110065, already taken by the appellant/ husband, on or before 01.01.2025.

Needless to state, upon the respondent shifting to the said accommodation, i.e. preferably in January, 2025 the appellant will pay her a lumpsum monthly amount of Rs.85,000/- per month towards maintenance, household expenses, water and electricity charges as also all other

miscellaneous charges in addition to the rental payment of Rs.40,000/- per month for the said rental accommodation.

The appellant, who is present in Court alongwith his mother, assures the Court that as and when the renovation in the matrimonial home i.e. 101, Jor Bagh, New Delhi-110003 is completed, the respondent alongwith the child will be permitted to shift back to the said premises and provided a reasonable living space in the house.

In light of this stand taken by the respondent, nothing further survives for adjudication in the present appeal, therefore, the present appeal is accordingly disposed of.

We, however, expect that the appellant will in deference to the wishes expressed by the respondent, look for a more suitable rented accommodation so that the respondent can alongwith the child and the appellant shift to the said accommodation in the near future.
