These petitions have been filed seeking quashing of cross FIRs being FIR No. 66/2012 under Sections 323/325/341/34 IPC and FIR No.65/2012 under Sections 506/453/323/341/34 IPC, both registered at P.S Greater Kailash-I, basis settlement arrived at between the parties.

Petitioners and complainant in both the matters are present before the Court and are duly identified by the IO and their respective counsels.

It is stated that the parties have amicably resolved their issues and have

no objection to quashing of the afore noted FIRs. The affidavits of No

Objection have also been appended along with the petitions.

Considering that the FIRs are of 2012, based on inter se disputes on property, and proceedings are at the stage of recording evidence, it is apposite if the parties pay costs.

Accordingly, it is directed that Mr. Gursharan Singh Oberoi shall deposit Rs. 1 lakh with Hemkund Colony Gurudwara on his own behalf as also on behalf of for Mr. Bhupinder Singh Oberoi and Ms. Ravneet Kaur Oberoi, while Mr. Parvinder Singh Sawhney shall deposit Rs. 1 lakh with Nanaksar Gurudwara on his own behalf as also on behalf of Jatinder Kaur Sawhney and Jasmeet Singh @ Bunty. The deposits be made within 3 weeks and affidavits of compliance along with receipts of deposits be filed before this Court within a week thereafter.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer.

Accordingly, the petition is allowed and cross FIRs being FIR No. 66/2012 under Sections 323/325/341/34 IPC and FIR No.65/2012 under Sections 506/453/323/341/34 IPC, both registered at P.S Greater Kailash-I and proceedings emanating therefrom are quashed, subject to deposit of costs.
