The learned counsel for the petitioners submits that the petitioners have been unnecessarily and falsely implicated in the present case.

He submits that the present FIR is an outcome of malicious prosecution.

¶12

He submits that Petitioner No.2 is a teacher in a reputed school. The present FIR is registered as a counter blast to the proceedings filed by the petitioners wherein the petitioners are seeking the eviction of the complainant’s father.

He, at the outset, submits that since the chargesheet has already been filed, he will take all arguments before the learned Trial Court and approach this Court in case any grievance remains in future. He, however, submits that since Petitioner

No.2 is a lady and a teacher, teaching in a reputed school, she may be exempted from personal appearance.

Considering the above, the present petition is dismissed as withdrawn with liberty given to the petitioner to raise all arguments before the learned Trial Court.

Needless to say, the petitioner is at liberty to approach this Court in case any grievance remains in future.

The petitioner is also at liberty to file an appropriate application before the learned Trial Court seeking exemption from personal appearance.

The learned Trial Court is requested to take a lenient view as and when any such application is filed.

The petition is disposed of in the aforesaid terms.

It is clarified that this Court has not commented on the merits of the case and the learned Trial Court shall pass an order after considering the arguments without being influenced by the disposal of the present case.
