The present application under Section 5 of Limitation Act, 1963 has been filed seeking condonation of delay of 140 days in filing the captioned petition.

Considering that the victim has already filed an appeal being CRL.A. 246/2023 , and for the reasons mentioned in the application, the delay of 140 days in filing of the captioned petition is hereby condoned.

30^th April, 2021 passed by ld. ASJ, Patiala House Court, New Delhi in Sessions Case No. 522/2019 arising out of FIR No. 985/2015, under Sections 498A/406/377/506/307/34 IPC, registered at P.S. Shalimar Bagh. Vide the said impugned judgment dated 30th April, 2021 the ld. Trial Court has acquitted the accused/Respondent Nos. 1 to 3.

The present criminal leave petition is allowed and disposed of. The same may be registered as a criminal appeal. Pending application, if any, is also disposed of accordingly.

As per the order dated 10^th April, 2024, passed in CRL.A. 246/2023 filed by the victim, the surety bonds in the sum of Rs. 10,000/- furnished by the Respondents have already been accepted and the verification report of the same was received from concerned SHO, which was recorded vide order dated 27th September, 2023.

Respondents are directed to remain present in the Court on the next date of hearing as well as on the dates fixed, either physically or virtually.
