After some submissions, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file the revision petition before the learned Sessions Court.
Liberty is granted and all contentions are kept open. It is made clear that no expression made herein shall tantamount to be an expression to the merits of the case.
In view of the above, the present petition stands dismissed as withdrawn with the liberty as prayed for.
The delay, if any, caused on account of filing of the present petition before this Court, the learned Trial Court shall condone the delay.
