This petition has been filed seeking quashing of FIR no. 351/2018 registered at PS Burari under Sections 363,376, 366 IPC and Section 6 of POCSO Act.

As per the Status report filed by the State, in 2018 respondent no.2 was found to be pregnant and, therefore, the FIR was registered.

However, both the petitioners and respondent no.2 are now major in age and have married two years back and have two children out of wedlock.

Both are present before the Court and are duly identified by the IO and the counsel.

In these circumstances, in order to give credence to the couple’s wishes and ensure that the couple and their children live in peace and harmony, this

petition is being accepted and FIR is being quashed.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No. 351/2018 under Sections 363,376, 366 IPC registered at PS Burari and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
