This petition has been filed seeking quashing of FIR No.354/2020, under sections 324/188/269/270/34 IPC at PS Tilak Nagar on the basis of settlement arrived at between the parties dated 21^st January 2022 before the Gurudwara Officials of Gurudwara Shri Guru Nanak Warha, Bhat Sikh Sangai, Vishnu Garden, New Delhi-110018, which is on record of this Court.

A perusal of FIR indicates that Section 188 IPC was inserted since the alleged incident happened during the restrictions because of Covid pandemic.

Petitioner no.1 and 2 and respondent no.2 are present in Court and are duly identified by IO and the respective counsel. Respondent no.2 states that petitioners are related to him and the dispute arose out of an altercation which has since been resolved. He further states that he has no objection to quashing of the FIR.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No.354/2020, under sections 324/188/269/270/34 IPC at PS Tilak Nagar and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement.

Accordingly, the petition is disposed of. Pending application is disposed of as infructuous.
