The present petition under Article 226 of the Constitution of India read with Section 528 of the BNSS has been filed by the Petitioner/husband seeking a writ in the nature of habeas corpus for production of his wife, Ms. ‘SA’ (daughter of Respondent No. 5).

It is the case of the Petitioner that he got married to Ms. ‘SA’ on 24th January, 2023 at Arya Samaj Mandir, Sundarpuri, Ghaziabad. The marriage has also been registered with the Registrar of Marriages. After the marriage, his wife-Ms ‘SA’ returned to her paternal home, allegedly on an assurance from her father-Respondent No. 5 that a proper social ceremony would be

conducted and she would be sent to her matrimonial home. However, the wife- Ms. ‘SA’ did not return to the Petitioner and subsequently, a complaint was filed by Respondent no. 5, i.e., father of Ms. ‘SA’, on the basis of which F.I.R No. 332/2024, under Sections 498A/376 of the IPC, was registered at police station Kheripur Faridabad, Haryana, wherein various allegations were made against the Petitioner. The Petitioner had to, then, seek anticipatory bail in the said case which upon being considered by the ld. Additional Sessions Judge, Faridabad; was granted vide order dated 21st August, 2024 after the survivor/wife-Ms. ‘SA’ had appeared before the ld. ASJ.

On the last date of hearing, as per the status report dated 14th October, 2024, which was given to the Court, the Court was informed that the wifeMs. ‘SA’ had made a submission that the Petitioner was pressuring and threatening her. In view of this submission, Ms. ‘SA’ was directed to be produced along with her parents today.

The Court has interacted with the wife Ms. ‘SA’, the Petitioner and parents of both the parties. Parents of the Petitioner are ready to accept Ms. ‘SA’, however, the latter has made it clear that she does not wish to accompany the Petitioner.

In view of the stand of Ms. `SA’, no further orders are called for in the petition and the same is, accordingly, disposed of.
