This petition has been filed on behalf of the Petitioner under Section 482 Cr.P.C. for quashing of FIR No.0154/2019 dated 19.03.2019 registered under Section 498A/406 IPC at PS Dwarka South, Delhi including the proceedings emanating therefrom.

Respondent No.2 is physically present in Court while Petitioner has joined virtually. It is stated by the parties that they have mutually resolved their disputes and have agreed to live together as husband and wife in the interest of the male child born from the wedlock, who is presently nine years of age. Respondent No.2 states that she has been assured by the Petitioner,

who is living in Canada and is an OCI Card holder, that he would be taking her and the child to Canada.

Learned APP, on the other hand, submits that another FIR has been registered against the Petitioner under Section 354 IPC, which has not been disclosed in the present petition. It is also stated that there is no written agreement of settlement between the parties and thus the terms of settlement are unclear. It is thus urged that in the absence of a Settlement Deed and in view of the non-disclosure of another FIR registered against the Petitioner, present FIR should not be quashed, at this stage.

Learned counsel for the Petitioner, on instructions, seeks permission to withdraw the present petition with liberty to file a fresh petition after a written agreement, incorporating the terms of settlement between the Petitioner and Respondent No.2, has been executed.

Petition stands disposed of as withdrawn with liberty as prayed, in accordance with law.
