The present petition has been filed by the Petitioner- Vikas Kumar under Article 226 of the Constitution of India read with Section 482 of the Cr.P.C. seeking issuance of a writ of habeas corpus directing Respondent Nos.1 to 3 to trace and produce the daughter and niece of the Petitioner before this Court.

On 5th July, 2024, the Court was informed that the two missing girls were having conversations with two boys from the neighborhood namely, Ritik Panchal and Sunny Jatav. Some recorded telephonic conversations were also produced before the Court. Accordingly, the Court directed that the said

two boys be remain present in Court on 6th August, 2024.

Both the girls have been located from Anandpur Sahib, Punjab. The girls are stated to have requested that they be produced before this Court. Accordingly, the matter has been listed on a special mentioning in the typed supplementary list.

We have interacted with the girls in the Chamber.

As per them, they left home on 15th March, 2024 and went to Khatu Shyam in Rajasthan. Thereafter, on the advice of Sonu Halwai , they went to Bihar and thereafter, to Ludhiana and Anandpur Sahib where they stayed with Mrs. Kulvinder Kaur, wife of Sonu Halwai .

The girls are minor and they state that neither Ritik Panchal nor Sunny Jatav misbehaved with them, however, Sonu halwai did ‘ galat kaam’ with them.

The two girls are cousins. One of them does not live with her parents as they have divorced each other a long time back and so she lives with her grandmother-Mrs. Sudesh, who is present today.

The Petitioner who is the father of the other girl is also present in person and is willing to accept the girl and take her home.

Accordingly, since both the guardians have agreed to take the girls home, they are being handed over to the said guardians i.e., the father and the grandmother.

This Court also records its appreciation for the efforts made by the Investigating Officer and police authorities who have traced the two girls.

The petition is disposed of in the aforesaid terms.

Pending applications, if any, also stand disposed of accordingly. Next date of hearing stands cancelled.
