In view of the judgment of the Hon’ble Supreme Court in cases DN Taneja v. Bhajan Lal, 1988 SCC (3) 26 and Midnapore Peoples Co-op. Bank v. Chunni Lal Panda and Ors., AIR 2006 SC 2190, the present appeal is not maintainable.
