Mr. Puneet Taneja, learned counsel for the petitioner, states that disputes between the parties have been settled. A copy of the Settlement Agreement dated 18.03.2024 has been handed up in Court and is taken on record.

Mr. Taneja states that the proceedings for execution of the impugned award are also pending in this Court [O.M.P.(ENF)(COMM) 199/2023]. He submits that the petitioner [judgment debtor in the enforcement proceedings] will make an application for disposal of the enforcement proceedings also.

Mr. Sudhir Sharma, learned counsel for the respondent [decree holder in the enforcement proceedings], confirms that the settlement has been entered into, and the amount deposited by the petitioner in the enforcement proceedings, is liable to be refunded in terms of the settlement.

As far as the enforcement proceedings are concerned, it is open for either party to make an application for disposal thereof, in terms of the settlement arrived at between the parties.

The present petition is disposed of in terms of the Settlement Agreement dated 18.03.2024. All pending applications also stand disposed of.
