Respective counsel for the parties submit that the parties have been able to amicably resolve their inter-se disputes through mediation. A ‘conciliated agreement’ dated 04.11.2024 has been executed between the parties. A copy of the same has been handed over during the course of the proceedings. The same is taken on record. “ settlement amount ” payable by the petitioner - TFB Food Ventures Private Limited to the respondent - Kavya Infratech Private Limited. The said settlement agreement also specifies date of vacation of the concerned premises and the consequences of non-vacation.

Respective counsel for the parties undertake, on instructions, that the parties shall remain bound and shall fully comply with the terms of the settlement agreement. It is further agreed that any breach of the terms of the settlement agreement will be treated as an egregious contempt and violation of undertaking made to this Court. The same is affirmed by the Authorized Representatives of the parties, who are present in person.

The present petitions are, accordingly, disposed of in terms of the aforementioned ‘conciliated agreement’. The parties shall remain bound by their aforesaid undertaking.
