A short question is involved in the present petition whereby the petitioner herein is seeking expeditious disposal of 3 Interim Applications (hereinafter referred as „IA‟) i.e. IA No. 2707 filed on 06.06.2023, IA Nos. 3826 & 3827, both filed on 06.10.2023, submitting that for one reason or the other, the 3 I.As, which are urgent are not being disposed of by the learned Debt Recovery Tribunal-I (“DRT-I”).

It is submitted that on account of non-disposal of the above mentioned 3 IAs due to one reason or the other, a lot of hardship is being caused to the petitioner herein, resultantly, he had to move further applications to seek redressal of his grievances. Thus, directions are required for disposal of aforementioned three interim applications with a time frame.

that apart from 3 I.As, the petitioner herein has also filed 8 other I.As and he is habitual in filing the said I.As, therefore, it is becoming difficult for the learned DRT-I to take up the I.As for disposal and thus the proceedings before the DRT-I are being delayed. It is also submitted that incorrect facts have been mentioned in the present petition by the petitioner by submitting that reply to the I.As have not been filed, whereas the truth is that the reply to the I.As have been filed on behalf of the respondent. It is submitted that in view of the above, the present petition is not maintainable.

It is not disputed that interim applications filed by the petitioner are pending disposal since June, 2023 and October, 2023, the replies to have already been filed, thus, the interim applications are ripe for hearing and disposal.

In view of the above submissions and circumstances, the learned DRT-I is requested to expeditiously dispose of the above mentioned I.As.

No further direction is required.

The present petition along with pending application is disposed of accordingly.
