The present petition has been filed under Section 439 Cr.P.C. seeking interim bail in connection with FIR No. 260/2023 under Sections 20/29/61/85 NDPS Act registered at Police Station Crime Branch on the ground that the petitioner is suffering from various medical issues.

Notice was issued in the application on 27.02.2024 with a direction to the State to file a status report. Further, on 05.03.2024, the learned counsel for the petitioner had furnished the address of Petitioner’s the friend namely, Priyojit with whom the petitioner would be staying in the event he is enlarged on interim bail.

The IO was directed to verify the aforesaid address of the petitioner’s friend. Today, a status report has been handed over in Court, the same is taken on record. A perusal of the status report shows that the address

mentioned in the order dated 05.03.2024 is not the correct address of petitioner’s said friend. However, on telephonic inquiry being made from the said friend of the petitioner, he gave his current address as H.No.-15, First Floor, Tower-1, Mohan Garden, L Block Extn, Uttam Nagar, New Delhi-110059. The said address has been verified and the petitioner’s friend has been found to be residing at the said address since 19.02.2024.

A perusal of the medical status report dated 12.02.2024 issued by the Senior Medical Officer, Central Jail No. 4, Tihar, New Delhi, shows that the petitioner is a known case of Gouty arthritis, hypertension and Chronic Hyperuricemia and he is also a known case of left kidney donor with persistent increase in uric acid level despite ongoing treatment for the same. The relevant part of the medical status report reads as under:

At present inmate patient is a known case of Gouty arthritis, Hypertension and Chronic Hyperuricemia with complaint of Multiple joint Pain, Left Knee Pain and Lower Back Pain on and off Haematuria, Bleeding per Rectum with Lower Abdomen Pain and Burning Micturition. Inmate patient is a known case of Left Kidney Donor with persistently increased uric acid level despite of ongoing treatment for the same (Latest report shows 9.6 mg/dl).

At present inmate patient is kept admitted at MI room CJ-04 Dispensary for round the clock monitoring and care.

Thereafter on 02/01/2024 and 05/01/2024 inmate patient was reviewed by doctor on duty for the complaint of

bleeding per rectum, lower abdomen pain, constipation, weakness, joints pain with follow-up case of chronic Hyperuricemia with left side kidney donor, for which after thorough examination, prescribed appropriate treatment, certain investigations and specialist review accordingly.

On 10/01/2024 his blood investigations have been carried out from jail dispensary itself and his uric level was found on higher side (9.6 mg/dl).”

A perusal of the said status report also reveals that the petitioner, after he was lodged in jail, had been admitted to DDU hospital on many occasions considering the severity of his ailments but there is not much relief to the petitioner. Thus, it appears that petitioner requires sustained treatment.

In view of the above, the petitioner is granted interim bail for a period of four weeks from the date of his release subject to his furnishing a Personal Bond in the sum of Rs. 50,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions:

a) Petitioner shall not leave the Delhi/NCR without prior permission of the Court.

b) Petitioner shall appear before the Court as and when the matter is taken up for hearing.

c) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without

prior intimation to the Investigating Officer concerned.

d) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses.

e) Petitioner shall report to the IO concerned once in fortnight.

The petitioner shall surrender before the concerned Jail Superintendent upon expiry of the period of four weeks.

The petition alongwith pending application stands disposed of.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance and information.
