An application under Section 439 of the Code of Criminal Procedure, 1973 (‘Cr.P.C.’) has been preferred on behalf of the petitioner for grant of regular bail in FIR No.0154/2023 under Sections 406/420/34 IPC registered at P.S. Hari Nagar.

Learned counsel for the petitioner submits that vide order dated 07.06.2024 passed by learned Vacation Judge, petitioner was admitted to bail, but the matter was kept pending to be taken up by the Roster Bench. He further informs that petitioner has already joined investigation, which is admitted by the learned APP for State.

Considering the facts and circumstances, since chargesheet has already been filed and petitioner is no more required for investigation, petitioner is admitted to bail on the same terms and conditions imposed vide order dated 07.06.2024, however, condition (f) as imposed in para 13 of order dated 07.06.2024 is withdrawn, in view of filing of chargesheet.
