This petition is filed seeking anticipatory bail in FIR No.128/2024 at PS Jyoti Nagar under Section 376 IPC. The Court had granted interim protection to petitioner by order dated 8^th May 2024.

The issue arises from the allegation by prosecutrix that she had met and befriended the petitioner on Facebook. Thereafter, as per the prosecutrix, he pursued her, and on several occasions booked hotel rooms to establish physical relations with her on a promise to marry. According to her, the relationship continued and other incidents are also complained of, as part of the FIR. On this basis the FIR has been registered.

APP for the State submits that investigation is almost complete; petitioner had joined and cooperated in investigation inter alia on 10^th May 2024 and provided mobile phone and other details requisitioned from him by the IO.

Counsel for the petitioner further points out that to numerous WhatsApp chats which, as per petitioner, is evident that petitioner and prosecutrix were in relationship. Further he contends that while the incidents complained of pertain to July 2022, the FIR was registered only on 4^th March 2024, the date when petitioner was getting married. He also points out to certain parts of FIR where it is stated by prosecutrix that petitioner was paying for her expenses, as also there was some purported settlement where Rs.5lakhs were given to her.

These contentions have been refuted by counsel for complainant, who is present along with the complainant.

In light of the above, the Court is of the considered opinion that the petitioner is entitled to anticipatory bail subject to his joining and cooperating in the investigation. 7. Consequently, in the event of arrest the petitioner be released on bail on furnishing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount subject to the satisfaction of the arresting officer/IO/SHO concerned, further subject to the condition that the petitioner will join investigation as and when directed and not influence any witness/complainant/victim or tamper with evidence of the case.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
