% 18.01.2024 1. The present writ petition has been filed challenging the tender dated 08^th January, 2024 issued by the respondent for the widening of road of Khammkam-Kurvi Section of NH365A in the State of Telangana. The grievance of the petitioner is that vide letter dated 08^th January, 2024 the bid submitted by the petitioner was rejected with remarks “ Technically NonResponsive as per clause 2.2.2.1 of RFP ”.

Learned counsel for the respondent states that the petitioner’s representation was rejected by the Evaluation Committee on 16^th January, 2024. He states that thereafter the Financial Bids were opened and the L-1 bidder has been declared. Learned counsel for the petitioner admits that the petitioner’s bid was higher than the L-1’s bid.
