Present writ petition has been filed challenging the order dated 28^th September, 2021 passed by the Financial Commissioner, New Delhi in Case No. 247 of 2017, order dated 11^th January, 2017 passed by the Respondent No. 1/RCS in No. REC.Exe.Case/10721 and order dated 11^th January, 2017 passed by the Respondent No. 1/RCS in No. REC.Exe.Case/10722.

Vide order dated 28^th September, 2021, the Petitioner was directed to approach the appropriate forum for challenging the order dated 11^th January,

2017 passed in No. REC.Exe.Case/10721 and order dated 11^th January, 2017 passed in No. REC.Exe.Case/10722 whereby the Respondent No. 1/RCS had directed regular deduction of Rs. 6000/- per month from the savings bank account of the Petitioner, who had stood as surety on behalf of Mr. Surjeet Singh and Ms. Anu Arora.

Learned counsel for Respondent No. 1/RCS states that the present writ petition is infructuous as all the deductions have already been made. He states that if the Petitioner has any grievance, he has to file recovery proceedings against the principal borrower.

This Court is in agreement with the contention of learned counsel for Respondent No. 1 that the present writ petition has become infructuous as the entire deductions have already been made.

Consequently, the present writ petition is disposed of as infructuous with liberty to the Petitioner to file appropriate proceedings for recovery from the principal borrower of the deducted amount, in accordance with law.
