The Petitioner has approached this Court challenging the Communication dated 01.01.2024 issued by Respondent No.3 refusing to issue the Letter of Technical Approval (LoTA) to the Petitioner on the ground that the Petitioner has not conducted the corrosion inhibition test for the batches bearing Nos. AFC-08/2019, AFC-08/2021 and AFC-07/2022 and also has not conducted the test of effect on rubber parts for the batches bearing Nos. AFC-01/2023 and AFC-02/2023.

It is the contention of the learned Counsel for the Petitioner that the

Petitioner has already undergone the aforesaid two tests for Radar System Coolant Antifreeze-65 in accordance with the JSS-9150-080:2012 specification before getting approval for starting the production. He states that post starting the production, the Petitioner need not have to undergo the said two tests. He further states that as per the accepted tests procedure, the Petitioner need to undergo these two tests after a period of two years or after the production of 10 batches.

When it was suggested to the Petitioner, keeping in view the fact that the product is required for Indian Air Force and also keeping in mind the costs of the airplanes, it would be expedient for the Petitioner, in the interest of the nation, to undergo the aforesaid two tests once again without prejudice to its rights and contentions, the Petitioner agrees to the suggestion given by this Court to undergo these two tests once again to the satisfaction of the Respondents.

In view of the above, let the aforesaid two tests be conducted by the Petitioner in accordance with the procedure within a period of 15 days from today and a decision thereon be taken by the Respondents within 10 days thereafter.

It is made clear that the present Order has been passed in relation to the present writ petition alone.
