This is an application filed by the petitioner seeking disposal of the writ petition in terms of the order dated 05.01.2024 passed in W.P.(C) No. 11902/2023.

Issue notice. Learned counsel for respondent nos. 1 and 2 accept notice and submit that taking into account that the petitioner is also aggrieved by the same impugned order dated 01.09.2023, which was the subject matter of challenge in W.P.(C) 11902/2023, they have no objection if the present petition is disposed of in terms of the order dated 05.01.2024 passed in W.P.(C) 11902/2023.

In the light of the aforesaid stand taken by the parties, the petitioner prayer for disposal of the writ petition in terms of the order passed in W.P. (C) 11902/2023 deserves to be accepted.

The application is accordingly allowed and the writ petition is disposed of in terms of order dated 05.01.2024 passed in W.P.(C) 11902/2023. Consequently, as directed vide order dated 05.01.2024, O.A.2254/2022 will also stand restored to the learned Tribunal for fresh adjudication on all the grounds raised in the O.A. except those which were already dealt with in the impugned order.

The next date i.e 25.01.2024 fixed in the matter stands cancelled.
