1. This petitioner Shashwata Dashora, assails notice dated 28 August 2023 issued by the Respondent Jamia Milia Islamia (JMI), whereby the petitioner was removed from the room in the hostel of the JMI, which was in her occupation. Consequent to interim orders passed by this Court, the petitioner was permitted to continue to occupy the said room.

Mr. Sabharwal, learned counsel for the JMI, submits that though the JMI is not in agreement with the petitioner that her removal from the hostel was unjustified, there has been no untoward behaviour, on the petitioner’s part, which has been noticed after she was reinstated in the hostel. He is agreeable, therefore, on instructions from his client, to allow the petitioner to continue to occupy the hostel and to utilise mess facility, subject to the petitioner conforming with all rules and regulations governing the hostel and agreeing to maintain

orderly conduct during her further period of stay in the hostel and not provide any cause for complaint.

3. Learned counsel for the petitioner, on behalf of his client, is ready to make the statement as sought by Mr. Sabharwal.

In view thereof, this writ petition is disposed of by permitting the petitioner to continue to occupy the room and mess facility, which was in her occupation in the hotel and to which stands reinstated pursuant to interim order passed by this Court on 7 November 2023 passed by this Court. This is, however, strictly subject to the petitioner providing no further cause for complaint and maintaining orderly conduct during the period of her continued stay in the hostel. The Petitioner shall also comply with all the rules and regulations applicable to hostel inmates.

5. Any breach in this regard from the petitioner would result in ipso facto vacation of this order.

6. The writ petition stands disposed of in the aforesaid terms.
