Petitioner has invoked the jurisdiction of this Court by filing a writ petition under Article 226 of the Constitution of India.

Respondent-Authority had come up with a Diwali Special Housing Scheme for disposal of 2093 soon to be completed flats at Dwarka (Sector-19B and Sector-14) through e-auction. Petitioner participated in the e-auction and was found to be a successful bidder for flat bearing no. I-502. 3. Respondent-Authority issue a demand-cum-allotment letter where a demand of Rs. 2,56,25,701/- was raised.

Petitioner has already, admittedly, paid 75% of the total cost. There was some issue with respect to the balance payment and according to petitioner, he was in no position to make balance payment as the flats were not ready and even in the interregnum, the respondent-Authority itself extended the time for making balance payment of 25% till 30^th November,

The present petition has been filed in August, 2024 and petitioner has now moved one application seeking permission to withdraw the writ petition. He submits that since he had already deposited 75% of the allotment amount to DDA and is ready to pay balance 25% of the amount to DDA within two weeks from today, he is no longer desirous of pursuing with his present writ petition.

Learned counsel for respondent-Authority appears on advance notice and submits that in case, the balance amount is deposited by the petitioner within two weeks from today, needful action shall be done by Delhi Development Authority (DDA).

Learned counsel for respondent-Authority submits that he has already received intimation from DDA that DDA has no objection to the aforesaid proposal.

Such statement is taken on record.

In view of the above, petitioner is permitted to withdraw the present writ petition with direction to take further steps, as mentioned in the application under disposal, within two weeks from today.

Present writ petition as well as the application under disposal stand disposed of accordingly.
