By this application the petitioner seeks anticipatory bail in case FIR No. 1087/2017 under Sections 406/498A/304B/34 IPC registered at PS New Usmanpur on the complaint of Salim Khan, father of deceased Ruby.

The investigation was set into motion in the above-noted FIR on receipt of DD No. 16B from Jag Pravesh Chandra Hospital Shastri Park, Delhi at PS New Usmanpur informing that one lady namely Ruby W/o Mohd. Faizan aged 23 years has been admitted with the history of ingestion of insecticide nuban poison at home on 23^rd October, 2017. During the course of treatment she died. Statement of father of deceased Ruby was recorded by the SDM wherein he stated that he had married his daughter to Mohd. Faizan on 17^th May, 2017. motorcycle, two lakhs cash and jewellery. It is alleged that Mohd. Faizan, Sarya, the mother-in-law and Naazrin, the sister-in-law used to torture his daughter Ruby on the pretext of dowry demand. It was further alleged that two maternal uncle Waseem and Asif used to abet the in-laws of his daughter to kill her. The complainant suspected that the accused persons killed his daughter.

Waseem, the petitioner herein, is the maternal uncle of the husband of the deceased. Mohd. Asif the other maternal uncle of the deceased with similar role has already been granted anticipatory bail by the learned Additional Sessions Judge.

Considering that the role assigned to the petitioner is similar to that of Mohd. Asif, the petitioner has joined the investigation and charge-sheet qua the petitioner is also complete and likely to be filed shortly, this Court deems it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest, the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will join the investigation as and when directed and in case of change of residential address the same will be intimated to the Court concerned by way of an affidavit.
