The petitioner seeks bail. He is accused of having committed an offence under sections 395/397/412/120-B IPC in FIR No.937/2015 registered at Police Station New Usman Pur, Delhi. He is behind bars since 27.07.2017.

The learned counsel for the petitioner submits that the petitioner is innocent and has been incarcerated for no fault and is behind bars for almost three years; of the seven accused, one is absconding and three had already been granted regular bail; and the petitioner has to take care of his widowed mother.

In view of the above, the petitioner is enlarged on bail on his furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the Trial Court concerned, subject to the following conditions:-

(i) the petitioner will regularly appear on each and every date of hearing

¶14

to be fixed by the Trial Court concerned;

¶15

(ii) the petitioner will not leave the country without prior permission of the Trial Court and the passport, if any, shall be deposited with the Trial Court concerned; and

¶16

(iii) the petitioner will duly intimate his new address and contact number to the SHO/IO of the case (in case of change) under intimation to the Trial Court concerned.

The petition stands disposed-off in the above terms.

Nothing stated in this order shall be deemed to be an adjudication on the merits of the case.

The Registry is directed to send a copy of this order to the Jail Superintendent, concerned for information.

A copy of this order be given dasti to the learned counsel for the parties.
