Vide the present petition, the petitioner who is a Scheduled Tribe (ST) candidate, is desirous of getting admission in Post Graduate medical course in respondent no.1/University. The petitioner, who is having a degree of MBBS from Vardhman Mahavir Medical College and Safdarjung Hospital affiliated to respondent no.3, has sought a direction to respondent no. 1 & 2, to take necessary action to fulfil the mandate of proviso to Clause 9 Sub-Clause III of the Post Graduate Medical Education Regulations, 2000 for the academic session 2018-19 and lower the minimum percentile for admission in the said course for ST category from 40^th percentile to 38^th percentile for ST candidates.

Learned counsel for the petitioner submits that the petitioner

has already made a representation dated 22^nd February, 2018, to respondent no.1 with a request to lower the percentile for ST students. He submits that at this stage, the petitioner would be satisfied in case a direction is issued to respondent no.1 to take expeditious decision on the said representation.

Issue notice. Mr.B.S. Shukla, Advocate accepts notice for respondent no.1, Mr.T. Singhdev, Advocate accepts notice for respondent no.2 and Ms.Anita Sahani, Advocate accepts notice for respondent no.3. Learned counsel for the respondent no.1 does not oppose the limited prayer made by the petitioner at this stage. Accordingly, respondent no.1 is directed to dispose of the petitioner’s representation dated 22^nd February, 2018, within two weeks from today by passing a reasoned and speaking order.

The petition is disposed of in the aforesaid terms.

Needless to say, in case the petitioner is aggrieved, he would be at liberty to take legal recourse as permissible under law.
